Where did you purchase the phone? If directly from Samsung or another vendor than Samsung updates the device BUT again, only models that are labeled UNLOCKED not specific carrier and than software unlocked - if from a carrier its up to the specific carrier to push the update-east check, if you have Tmo or Vzw bloatware on device than you wait for them...
