 The tv is there is a software update. When I follow the instructions for updates, I keep getting failed to update notifications 

Old software 1310
New software 6500

Why isn't it updating

Since the TV is still presenting an error regarding the update after a factory reset, and using an empty and FAT32 formatted USB drive as an alternative, we ask for you to Private Message any moderator by selecting and clicking on the chat option with your full model and serial number. We can assist you directly via PM as the next recommended step is to have a service technician determine what's occurring with the TV and provide a solution to this matter.

Followed the steps that were visible and factory reset the tv x2 , with the same results

The website is NOT showing the updated software. the only place that is showing that is the TV it self

Find it strange that the upgrade goes from 1310 to 6500 and Samsung's download page for my tv doesn't even show 6500 as an option to download.
