Z fold 5 shearing at the hinge

I would just like to state right away that i've never dropped this phone and it has a case.

I bought the z fold 5 back in july/august for its compact size however I noticed fairly early on that the tiny rubber band within the hinge kept popping out. I managed to get it back in each time but gradually its gotten worse to the point now where the plastic edging is actually shearing away from where the hinge in on both sides of the screen. 

I don't really know where to go from here, i think my carrier and Samsung themselves will try to say that this is my fault and charge me for repairs but i think the issue is only going to get worse
