My brother relocated he left his phone to me James W i cant move forward with is email as owner can we please deleat my dear brother from the device?

That would be in the account settings to change the email etc if you have the password

You can delete accounts in settings > accounts and backup > manage accounts then delete your brother's account
I have the same phone I had to do the same thing with sisters accounts
